Personal and Professional Background

Mr. Attlesey was raised in Santa Barbara, California and earned his undergraduate degree in Political Science with a Business emphasis from the University of California at Los Angeles in 1989. While at UCLA Mr. Attlesey was a member of the Bruin Volleyball team and was actively involved in Phi Kappa Psi fraternity. He went on to earn his Juris Doctor in 1993 from Golden Gate University in San Francisco, California, where he served on Law Review and was awarded the American Jurisprudence Award for Writing and Research. Mr. Attlesey is admitted to the California State Bar and U.S. District Court, Central and Southern Districts of California.

 

From 1993 until 1995, Mr. Attlesey practiced as an associate attorney with the Santa Barbara law firm of Reetz, Fox & Bartlett, representing clients in the development, leasing and purchase and sale of residential and commercial real estate, landlord-tenant matters and collections. In 1995 Mr. Attlesey joined an Orange County, California based law firm specializing in representing REO departments of institutional lenders, property owners, property management companies and developers in landlord-tenant matters, including unlawful detainer actions, commercial breach of lease cases and collections. In 1996 Mr. Attlesey began his solo practice which expanded into a broad-based and sophisticated real estate and business practice, leading to the 2009 formation of Attlesey|Storm, LLP. For three consecutive years Mr. Attlesey was selected by Law and Politics Magazine as one of the top 5% of attorneys in Southern California, earning the publication’s designation of “Super Lawyer” in
real estate law.

 

Real Estate Transactions

Mr. Attlesey works with owners, landlords, sellers, buyers, tenants, borrowers, lenders, investors, real estate brokers and agents, property managers, and developers in acquiring, selling, leasing and financing commercial property. His services cover the entire transactional process from deal inception to closing, including negotiating, drafting, and reviewing residential and commercial real property purchase and sale agreements, leases, escrow instructions, loan documents, opinion letters, title reports, property management agreements, due diligence materials, and related documents. Real Estate Disputes and Litigation

Mr. Attlesey represents clients in real estate litigation and trials in the following areas: Landlord-Tenant: Unlawful detainer (eviction) actions, breach of lease and security deposit disputes, and post-tenancy issues (e.g., removal of fixtures, equipment and improvements, damage to property, etc.); Purchase and Sale: Specific performance, breach of contract, non-disclosure, improper retention of earnest money deposits and liquidated damages; Foreclosure: Pre-foreclosure through post-foreclosure sale issues for lenders, investors, bidders and owners related to confirming and rescinding sales, non-disclosure defense, title issues, lien releases, senior lienholder negotiations and payoffs, excess sales proceeds, and surplus proceeds distribution and recovery; and Title: Lien holder disputes, trespass, damage to property, boundary disputes and easement issues. Business Litigation and Transactions

Mr. Attlesey represents clients in business litigation and trials involving breach of contract, fraud, unfair business practices, negligence, and general business matters. He has litigated over 100 cases, and assists clients through the entire litigation process, from pre-dispute, through mediation, arbitration, trial and appeals. In providing those services, he works closely with his clients in negotiating, drafting and reviewing an array of business-related contracts including acquisition and disposition of businesses, service contracts, employment and independent contractor agreements and general business and corporate contracts. Mr. Attlesey also assists clients in setting-up new business entities, including limited liability companies, corporations and partnerships.

 

Collectibles Law

Mr. Attlesey has represented clients in the sports trading card, autograph authentication, and coin collectibles industry for over 25 years. He has litigated and tried multiple cases arising out of third party autograph authentication, collectibles grading, collectibles auctions, and collectibles consignments. Mr. Attlesey also represents vendors, service providers, buyers and sellers in collectibles industry transactions by negotiating, drafting, and reviewing collectibles hobby contracts. Mr. Attlesey represented the seller in what is believed to be the largest, in volume and price, private sale of sports trading cards in the history of the memorabilia industry.
